Purpose and acceptance
This legal notice governs the use of the website www.binhex.cloud and the services provided by BINHEX SYSTEMS SOLUTIONS S.L. (hereinafter, BINHEX).
The website's primary objective is to facilitate contact between users and the company, as well as to provide access to BINHEX's cloud services platform. Browsing the page and/or contracting its services grants the status of user and implies full and unconditional acceptance of each and every provision included in this Legal Notice and the linked Acceptable Use Policy (AUP), which may be subject to changes.
The user agrees to make proper use of the website and the contracted services in accordance with the laws, good faith, public order, traffic usage, and this clause. The User will be liable to BINHEX and to third parties for any damages that may arise as a result of the breach of this obligation.

General conditions of access and use
The website is freely accessible and free of charge, although the use of certain areas or the contracting of cloud services is subject to completing data collection forms and accepting the subscription agreements.
- Minimum age: Only individuals over 18 years old will be able to contract services and provide information through our website. Minors under 16 years old cannot provide this information without the consent of their parents or guardians.

The User expressly agrees to make appropriate use of the content, the website, and the cloud services of BINHEX. It is strictly prohibited to use the infrastructure for:
1. Illegal, fraudulent, or harmful use
- Illegal activities: Disseminate, store, or process criminal, violent, racist, xenophobic, offensive content, glorification of terrorism, illegal gambling, or content contrary to the law and public order.
- Fraud and Deception: Advertise misleading goods, services, or schemes (Ponzi schemes, pyramid schemes, get-rich-quick schemes, phishing, or unauthorized financial services).
- Infringing content: Infringe on intellectual or industrial property rights, as well as violate the confidentiality of BINHEX's information or that of third parties.
- Degrading and intimate material in consensual: Storing or distributing child pornography, zoophilic material, or non-consensual intimate visual representations, including digitally manipulated images or videos (deepfakes) of a sexual nature without consent.
2. Technical and network resource abuse
- Malware: Introduce computer viruses, trojans, worms, or any malicious software capable of altering or damaging the logical systems of BINHEX or third parties.
- Attacks and overload: Perform Denial of Service (DoS/DDoS) actions, massive API calls without throttling that degrade the service, abusive automated crawling, or any deliberate overload of resources.
- Unauthorized audits: Conduct security analysis, automated scans, or audits on BINHEX systems without prior written consent.
- Impersonation and hacking: Impersonating another user, public administrations, or third parties, as well as attempting to access restricted areas or conduct data espionage.
3. Abuse of communications and Spam
- Spamming: Sending or facilitating unsolicited bulk emails or messages (Spam). Any legitimate bulk sending must have the explicit consent of the recipient.
- Spoofing: Send emails by spoofing headers or impersonating identities.
- Spam SEO: Publish content for the purpose of abusive positioning (black hat SEO), such as fraudulent link building, improperly using the reputation of BINHEX.
Procedure in case of illegal activities and content removal
BINHEX is firmly committed to regulatory compliance and cooperation with authorities and infrastructure providers.
- Abuse notification: If any user or third party detects facts that reveal illegal use of the services or the website, they must send an urgent notification properly identifying themselves to: 📧 info@binhex.cloud.
- Action Deadlines and Withdrawal Requirements: By virtue of the applicable legal frameworks (including urgent international regulations such as the TAKE IT DOWN Act for the removal of non-consensual intimate images and deepfakes), BINHEX will act with the utmost urgency.
- If BINHEX forwards a content removal request to the client, they will have a maximum period of 24 hours to process it.
- BINHEX reserves the right to temporarily withdraw content or restrict access to the service immediately before the end of the specified period to ensure legal or contractual compliance. Failure to meet deadlines by the client will entitle BINHEX to suspend or restrict the service.
